    As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.

    The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

    The White House plans to try implementing as much new policy as it can by administrative order while stepping up its confrontational rhetoric with Congress after concluding that President Bush cannot do much business with the Democratic leadership, administration officials said.

    According to those officials, Bush and his advisers blame Democrats for the holdup of Judge Michael B. Mukasey's nomination to be attorney general, the failure to pass any of the 12 annual spending bills, and what they see as their refusal to involve the White House in any meaningful negotiations over the stalemated children's health-care legislation.

    White House aides say the only way Bush seems to be able to influence the process is by vetoing legislation or by issuing administrative orders, as he has in recent weeks on veterans' health care, air-traffic congestion, protecting endangered fish and immigration. They say they expect Bush to issue more of such orders in the next several months, even as he speaks out on the need to limit spending and resist any tax increases.

    The events of recent weeks have "crystallized that the chances of these leaders meeting the administration halfway are becoming increasingly remote," said White House spokesman Tony Fratto.

    Bush himself has been complaining more and more bitterly about congressional Democrats in recent weeks. In a private meeting yesterday with House Republicans in the East Room of the White House, Bush recalled how he had been able to work with Democrats when he was Texas governor and said he had hoped to find the same relationships in Washington.

    "He sort of longs for those days, when both sides were genuinely interested in getting along and getting a deal," said Rep. Adam H. Putnam (R-Fla.), the chairman of the House Republican Conference, who helped organize yesterday's White House meeting, attended by about 150 Republicans.

    The president offered more criticism after the session. "Congress is not getting its work done," Bush said. "We're near the end of the year, and there really isn't much to show for it."

    House Democratic leaders fired back at Bush with strong rhetoric of their own. "The president wants the same complacent, complicit Congress that was a co-conspirator in a coverup of what was going on in this country," said House Majority Leader Steny H. Hoyer (D-Md.).

    Both sides have their own political calculations for digging in, with the White House and Republicans seeking to reestablish their credentials as fiscal conservatives and with Democrats concluding that they are on the right side politically on children's health care and other issues.

    On some issues, the White House has become increasingly left out of the legislative process. Bush's objection to any tax increases, for instance, has pushed Republicans in the House and the Senate to pursue their own negotiations over an expansion of the State Children's Health Insurance Program (SCHIP), concluding that a final bill must include a significant tobacco tax increase to offset its cost.

    Even as they offer the president public support, some Republicans on the Hill are hinting that they might break with Bush if the price is right. Asked yesterday whether he could support an SCHIP bill that Bush opposes, House Minority Leader John A. Boehner (R-Ohio) suggested that is a possibility. "He has his position. House Republicans have theirs," Boehner said.

    While Bush castigated Democrats for lack of productivity, congressional Republicans have had their own reasons for moving slowly. On SCHIP, for example, they have said that both sides could reach a deal if the Democratic leadership would slow down and let negotiations proceed.

    GOP Sens. Charles E. Grassley (Iowa) and Orrin G. Hatch (Utah) personally appealed to Senate Majority Leader Harry M. Reid (D-Nev.) for a delay yesterday. Reid agreed and asked the Senate to put off consideration of the latest version of the bill to let bipartisan talks continue. This time, Senate Minority Whip Trent Lott (R-Miss.) objected to the move.

    "That makes an interesting statement about the president's press conference this morning, that we just can't get those Democrats to do anything," said Sen. John D. Rockefeller IV (D-W.Va.), one of the SCHIP negotiators.

    Hi,

    I want to go outside of US and return back on December 8, 2010 while my passport expires on June 6, 2011. I will be entering on an advance parole document obtained as an I-485 applicant. As such at point of entry my passport will be expiring in less than 6 months (5 months 28 days). Please let me know if the passport needs to be valid for 6 months at the time of entry or this restriction does not apply to entry based on parole.

    Congress Needs Both Comity and Accomplishments (http://aei.org/publications/pubID.27104,filter.all/pub_detail.asp) By Norman J. Ornstein | Roll Call, November 14, 2007

    A look at the range of public opinion surveys on Congress in recent days, weeks and months can't leave anybody happy. The most recent Associated Press-Ipsos survey showed a 25 percent approval rating, coupled with a staggering 70 percent disapproval--a 45 percent gap in the wrong direction. The most recent NBC-Wall Street Journal survey showed 19 percent approval and 68 percent disapproval, for a 49 percent gap.

    Democrats are taking comfort from the fact that much of the anger and disappointment people feel is aimed at Republicans. It should be scant comfort. To be sure, a recent ABC-Washington Post poll showed Republicans at 32 percent approval and 63 percent disapproval. But Democrats are not exactly exempt from public disgust; the same survey showed only 36 percent approval for them, with 58 percent disapproval. If Democrats think they can count on the unhappiness with President Bush and the residue of repugnance with the performance in Washington when the Republicans controlled all the levers of power, they are delusional. There is clearly a broader public anger about the performance of most institutions, but especially those in Washington, and it could very, very easily turn into a broader and deeper reaction against the status quo and all incumbents.

    Dig a bit deeper, and it is obvious that voters are tired of the partisan bickering and ideologically driven rancor--they want problems solved in Washington, not yelling or posturing or revenge killing that only results in gridlock. The latter is what they see coming out of Congress.

    Of course, this is not entirely fair. The 110th Congress has some significant accomplishments, including implementing the 9/11 commission recommendations, increasing the minimum wage, expanding college aid, implementing "pay-as-you-go" budgeting and working hard to make it a reality, and passing significant lobbying and ethics reform. But many other things have passed the House and foundered in the Senate, or been stopped, like children's health insurance, by a presidential veto. And, of course, Congress has spent countless hours trying futilely to do something to change course in Iraq.

    Just as important, the image of Congress is far more that of a dysfunctional body riven with partisanship than a well-oiled, or even marginally oiled machine working hard to help the country and its people with their daily challenges. On this front, the blame is widespread, going both to an irresponsible minority and an insensitive majority.

    But the onus is especially heavy on the majority. It is the majority, especially in the House, that has the power to shape debate and either to open up or shut down the process to ideas, amendments and involvement by rank-and-file Members in both parties. It is the majority that has to rise above the cheap shots, irresponsible motions to recommit and outrageous rhetoric, both to serve the larger interests of the House and to serve their own partisan interests in maintaining a majority.

    The attitude of some Democrats, including some in the leadership, is eerily reminiscent of the Republican leaders in 2005 and 2006--voters don't really care about the internal dynamics of Congress, and even if they are unhappy, our fundraising advantages and strong candidate recruitment will keep us in charge. That is a formula for repeat disaster. Even if Democrats can continue to maintain a thin edge over Republicans in the approval/disapproval ratio, keep up their funding advantage and gain leverage from the retirements of many Republican moderates in contestable districts, their ability to hold a majority beyond 2008 will be severely limited.

    The first thing Democrats should do is develop a basic sensitivity and avoid doing stupid things that gain nothing except additional enmity from their counterparts. A good example was the utterly foolish decision to schedule a revote on SCHIP when many Republicans from California were back home tending to their constituents in the midst of the disastrous fires. There was no good reason for pushing that vote instead of delaying it until Members could be back to participate. It reminded me again of the high-handed and insensitive behavior of Republicans in the 109th Congress, when they would quash debate or screw the Democrats for no good reason other than that they had the power to do so.

    The second thing Democrats should do is to accept the possibility of defeat on the floor as something short of a disaster. The biggest failing of the GOP in the 109th was an unwillingness to lose no matter what. Of course, you don't want to lose, and can't afford to lose on some basic important issues and priorities. But in other cases, amendments can be constructive or no great disaster (and in some cases, amendments the majority doesn't like can be allowed to pass and jettisoned in conference).

    The third thing Democrats should do is to move aggressively to more debate, and not only between Democrats and Republicans. Now is a perfect time to revive the idea of regular prime-time debates on important issues. Take one evening a week, in special orders, and structure a lively debate on something of concern to the country. Have two or four Members lead the way in debate, and follow with a free-for-all discussion. In some cases, say global warming or trade, have both majority and minority Members on each side. Add to that a regular process of having real debate on bills that reach the floor whenever possible.

    Now a fourth suggestion: It is possible that Minority Leader John Boehner (R-Ohio) and Minority Whip Roy Blunt (R-Mo.), who are legislators, would react to a new Democratic attitude and approach with their own constructive responses. But it also is possible that they, egged on by their own bomb-throwers, would just try to take advantage of any new opening for greater partisan leverage. So Democratic leaders should also open up serious lines of communication with the retiring Republicans such as Reps. David Hobson (Ohio), Ray LaHood (Ill.) and Deborah Pryce (Ohio). Make a deal: We will bend over backward to accept your amendments and the nonfrivolous or nongotcha ones by your colleagues, and to be more fair and open, if you offer such amendments and encourage others, and if you object to irresponsible motions to recommit. The retirees have one last opportunity to make a difference in the way the House operates and in helping to solve the nation's problems. It is a long shot, but it just might work.

    Hi Sukhpreet, are you sure the actual petition was filed and denied, or just the labor condition application (LCA) was denied? The LCA is one component of the H-1B petition; it requires a valid FEIN number, and it needs to be certified in order for the H-1B petition to be filed. Most likely, this is what has been denied because the DOL could not find/match the number. The lawyer can just refile the LCA with the appropriate IRS documentation, and it should be certified within a week. The H-1B petition can then be filed with the certified LCA.

    I'm in the process of a COS and was denied an R1 petition. Here's my case, and it would greatly help me if someone could assist me in determining whether my countdown of unlawful presence and unlawful status has begun.
    Aug 15, 2004 Arrived on a F1
    Jul 21, 2009 F1 expired
    Aug 20, 2009 Filed for R1
    Aug 24, 2009 OPT expired
    Nov 18, 2009 R1 status denied
    Dec 18, 2009 Appeal of Decision

    After the expiry of my OPT i still continued to work whilst my R1 petition was in process. Does this violate my status automatically, or does it begin when it is determined by the USCIS? If it does, does my 180 days countdown to unlawful presence begin from Aug 24, 2009, or from the denial of my R1 petition? IF i appeal the decision will that nullify the days counted against me if any? And as i await the appeal decision, which apparently take 5 months, what would be my lawful/unlawful status/presence?

    Hello Friends,

    I have a question regarding waiver on J2 EAD.
    My husband is doing residency on J1 since last 9 months. His residency program is of 4years and plans to do 1 yr fellowship later on on J1 so total of 5 yrs
    I m now on J2 and have an EAD with me.
    My questions are:

    1. Do I need to do a waiver job after I complete my residency on EAD before joining any other hospital here in the US? or it just applies to my husband(on J1) to do a waiver.

    2. If aftercompleting my residency on EAD, if my husband gets a waiver he will be on H1 and me on H4and if the same year I get H1 fellowship program for 1 yr, can I change my status from J2 EAD to H1 without doing a waiver?

    3. How much time it normally takes to renew your EAD?

    I know many friends of mine, who has done B.E and MS from diferent background (like Mechanical, Electronics etc) and were still able to get the LC approved from a software company since they were working there. There should not be any issue with it.

    Hi all,

    I am in a strange situation-- I have 2 different PDs.

    1) PDs on my I-140 is listed: June 30, 2005 (which became current as of 2/11/2011)
    2) I recently discovered a different PD listed on the Request for Initial Interview Notice (for my pending I-485). There is a Priority Date box on this notice letter, and date listed is Aug 16, 2007.

    Biometrics done Nov2007
    Initial Interview done June 2010
    FingerPrint done August 2010
    Currently on 3rd EAD
    Nationality is Taiwan
    Current status: AOS pending

    I am torn and confused because 2 PDs are 2 years apart. Does any one have the same issue like me? What should I do??? Which PD is the correct one I should go with?? Please help! Thank you so much in advance for your time.

    If I have I140 approved and I have 3 year extention after my 6 years on H1B. Can I get H1B transferred to a new employer and then start my Labour all over again.

    Yes, it can be done...and good news is you can preserve your Priority date too.
